Candidate Agent Terms of Service

Welcome to HiringSky! These terms apply to our "Candidate Agent" services. We've written them in simple language to be as clear as possible. By purchasing this service, you are agreeing to these terms.

1. When Your Service Begins

Our service is considered to have officially commenced (started) immediately after we complete our initial Career Alignment Session (Project Kick-Off Meeting).

2. Our Refund & Satisfaction Policy

2.1 No Cash Refunds

Due to the personalized, strategic, and advisory nature of our service, all fees are non-refundable once the Career Alignment Session has been completed. The fee compensates us for the time, expertise, and custom strategy we provide during and after that call.

2.2 Our Commitment to You (The Remedy Policy)

We are committed to your satisfaction. If an issue with our service arises that is attributable to HiringSky (our fault), we will provide a non-cash remedy in place of a refund.

At our discretion, this remedy may include one of the following:

  • One (1) additional revision cycle for a resume or LinkedIn profile;

  • Replacement of up to three (3) job leads that do not meet our mutually agreed-upon criteria;

  • One (1) additional 30-minute follow-up coaching call; or

  • A $25 service credit toward a future HiringSky service.

3. Your Responsibilities as a Client

Our service is a partnership. To deliver the best results, we need your timely participation and feedback. The remedies listed in Section 2.2 do not apply to issues or delays caused by you (for example, not providing information we need or missing scheduled calls).

Client-caused delays may result in your service being paused or the timeline being extended. If your delays prevent the completion of the service, the service will be considered fulfilled and is non-refundable.

4. Scheduling & Rescheduling Policy

We value your time and ours. Please review our scheduling policies for all calls and sessions.

Time Zone: All appointment times are scheduled in **America/New_York (EST/EDT)** unless otherwise agreed upon in writing.

Rescheduling (24+ hours' notice): You may reschedule your session **one (1) time** for free, as long as you provide at least 24 hours' notice. Additional reschedules may incur a $25 fee or a shortened session.

Late Cancellation (Less than 24 hours' notice): If you cancel with less than 24 hours' notice, the session is deemed delivered and becomes non-refundable. A paid make-up session may be offered at HiringSky's discretion.

Late Arrival (1-19 minutes): If you arrive late, your session will be shortened and will still end at the originally scheduled time.

No-Show (20+ minutes): Arriving 20 minutes or more late to a meeting without notice will be considered a "No-Show." The session is forfeited and non-refundable.

Emergencies (Force Majeure): We understand that documented emergencies happen. A one-time courtesy reschedule may be offered at HiringSky's discretion.

5. Confidentiality (A Two-Way Street)

We will keep all of your information (resume, career goals, personal details) strictly confidential.

Likewise, you agree to keep our proprietary information (our research methods, document templates, and strategies) confidential. We both win when we keep our work private.

6. Our Guarantees & Limitations

Our service is a partnership. We provide expert coaching and strategic advice to help you in your job search. We do not, however, guarantee that you will be hired for a specific role or achieve a specific career outcome, as that depends on your own efforts, market factors, and interview performance.

You agree that in the unlikely event of a dispute, HiringSky's total financial responsibility (our "liability") to you will not exceed the total amount you paid for the service.

7. Dispute Resolution

We hope we never have a serious dispute. But if one arises, we both agree to resolve it in a fair and efficient way.

A. Informal Resolution

Before taking any formal action, you agree to first email us at contact@hiringsky.com, provide a description of your concern, and work with us in good faith to resolve the issue informally.

B. Binding Arbitration

If we cannot resolve the dispute informally within thirty (30) days, we both agree to resolve any claim relating to these terms or our services through final and binding arbitration. This means you are waiving your right to go to court and have the dispute heard by a judge or jury. The arbitration will be conducted in New York, NY, or remotely, under the rules of the American Arbitration Association (AAA).

8. Other Legal Terms

A. Governing Law

This agreement and any dispute arising from it will be governed by the laws of the State of New York, without regard to its conflict of law provisions.

B. Class Action Waiver

You agree to resolve any dispute in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

C. Entire Agreement

These terms constitute the entire and exclusive agreement between you and HiringSky. These terms supersede all prior or contemporaneous discussions, promises, or agreements, whether written or oral, regarding this subject.

D. Severability

If any part of these terms is found to be invalid or unenforceable, that part will be enforced to the maximum extent possible, and the remaining terms will remain in full force and effect.
