Candidate Agent Terms of Service

Welcome to HiringSky. This Candidate Agent Service Agreement ("Agreement") is entered into between HiringSky ("Agent" or "Company") and the Client ("You"). By purchasing the Candidate Agent Service, you agree to be bound by these terms.

1. Scope of Service

The "Candidate Agent Service" is a fixed-scope, 5-day strategic sprint. It is a consulting and document preparation service, not a recruitment or placement service.

Deliverables Include:

  • One (1) 30-Minute Career Alignment Session.

  • Creation of Personal Branding Assets (Resume & LinkedIn Profile Optimization).

  • Creation of a "Targeted Search Strategy Brief" (PDF).

  • Provision of "Recruiter-Access Scripts."

  • Five (5) days of asynchronous coaching via a private Trello board.

  • Bonus 1: The "Interview Playbook" (PDF).

  • Bonus 2: The "30-Day Momentum Tracker."

Note on Deliverables: The "Targeted Search Strategy Brief" is a strategic roadmap containing recommended target companies and search methods. It is not a guarantee of a specific number of active job vacancies, interviews, or "leads."

1.1 Service Extensions (The "Add-On" Option)

The 5-Day Sprint is designed for rapid execution and asset creation. If the Client wishes to extend the coaching period, requires additional rounds of revisions beyond the Sprint, or desires ongoing support, these services may be purchased as a "Weekly Support Add-On" at the Agent's current consulting rate. The Agent is under no obligation to provide free support beyond the 5-day term.

2. Service Commencement & Refund Policy

2.1 Immediate Commencement

Our service is considered to have officially commenced immediately upon purchase, as you are granted instant access to our proprietary "Career Discovery Workbook" and intellectual property.

2.2 Refund Policy

Due to the digital nature of our assets and the reservation of the Agent's time, fees are generally non-refundable. We offer specific exceptions based on the stage of work:

  • Pre-Work Cancellation: If you request a cancellation within 24 hours of purchase AND before you have completed the "Career Discovery Questionnaire" or scheduled your Kick-Off Call, we will issue a full refund minus a 5% transaction processing fee.

  • Post-Work Non-Refundable: Once the Career Discovery Questionnaire has been submitted OR the Kick-Off Call has occurred, the service is considered "consumed" and no cash refunds will be issued.

3. Our Guarantee: The 30-Day Strategy Diagnostic

We stand behind our system. While we cannot control the market, we ensure you do not face it alone.

If you utilize our assets and strategy consistently for 30 days without generating increased traction, you are eligible for a complimentary Strategy Diagnostic.

3.1 Eligibility & Verification

To qualify, you must submit a "30-Day Activity Log" demonstrating that the strategy was executed. This includes proof of applications submitted and direct outreach messages sent using our scripts.

3.2 The Remedy

If eligible, HiringSky will provide:

  • A strategic review of your activity data.

  • Identification of bottlenecks.

  • One (1) targeted refinement to your resume or outreach scripts to re-align with the market.

  • This diagnostic is the sole remedy available for satisfaction guarantees. We do not offer cash refunds or service credits.

4. Client Responsibilities & Integrity of Materials

4.1 The "Homework" Requirement

You agree to complete the "Career Discovery Workbook" in full before scheduling your Kick-Off Call. Failure to provide detailed information may result in the rescheduling of your call.

4.2 Timely Participation

Our 5-Day Sprint relies on momentum. You agree to provide feedback on drafts within 24 hours via Trello. Delays caused by the client may result in the service timeline ending before revisions are complete. All work and communication occur during business days (Monday-Friday, 9:00 AM - 5:00 PM EST), excluding Federal Holidays.

4.3 Strategic Exclusivity & AI Prohibition

Exclusivity: To ensure success, the Agent shall be the primary strategist for all materials during the term.

No AI Modification: The Client agrees NOT to fundamentally alter, rewrite, or "re-tailor" the approved application materials using Artificial Intelligence (AI) tools (e.g., ChatGPT, Claude, Resume.io) without prior written consent.

Breach: Submitting AI-altered versions of the Agent’s work violates the strategic integrity of the campaign. The Agent reserves the right to terminate this agreement immediately without refund if this clause is violated.

5. Scheduling & Rescheduling

Time Zone: All appointments are in America/New York (EST/EDT).

Rescheduling: You may reschedule your session one (1) time for free with 24 hours' notice.

Late Cancellation/No-Show: Canceling with less than 24 hours' notice or arriving 15+ minutes late forfeits the session. The service will proceed based on the information provided in your workbook.

6. Disclaimer of Results (No Placement Guarantee)

HiringSky is a Strategic Advisor, NOT a Placement Agency.

You acknowledge that:

  • We do not have control over hiring managers, ATS algorithms, or market conditions.

  • We do not guarantee interviews, callbacks, or job offers.

  • Any "leads" or "contacts" provided are for networking purposes only and do not constitute a referral or job promise.

7. Limitation of Liability

To the maximum extent permitted by law, HiringSky shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. In no event shall our total liability exceed the actual amount paid by you for the service.

8. Client Conduct & Termination at Will

We foster a professional, respectful, and collaborative environment.

8.1 Prohibited Behaviors

The Agent reserves the right to terminate this Agreement immediately, without refund, if the Client engages in:

  • Harassment: Abusive, aggressive, or demeaning communication toward the Agent or staff.

  • Unreasonable Demands: Expectation of communication outside business hours, excessive messaging volume (spamming), or demands for services outside the Scope (Section 1).

  • Strategic Non-Compliance: Consistently ignoring strategic advice or altering materials (see Section 4.3) in a way that sabotages the campaign's success.

8.2 Termination Procedure

In the event of termination for conduct, the Agent will provide written notice via email. Access to the Trello board may be revoked, and all work completed up to that point will be considered the final deliverable.

9. Non-Disparagement

During the Term and for a period of twelve (12) months thereafter, the Client agrees not to make any false, disparaging, or negative statements regarding HiringSky, its services, or its agents, on any public forum, review site, or social media platform, particularly in the event of termination under Section 8.

10. Dispute Resolution

A. Informal Resolution: If a dispute arises, you agree to first email us at contact@hiringsky.com to resolve the issue informally in good faith.

B. Binding Arbitration: If unresolved within thirty (30) days, any claim shall be resolved through final and binding arbitration under the rules of the American Arbitration Association (AAA). You waive your right to a trial by jury or to participate in a class action lawsuit.

11. Governing Law & Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Venue: Any legal action or proceeding arising under this Agreement that is not subject to arbitration shall be brought exclusively in the federal or state courts located in New York County, New York.

12. Confidentiality & Intellectual Property

12.1 Agent Obligations

The Agent agrees to keep all Client career data, resume details, and coaching conversations strictly confidential. The Agent will not share the Client's specific application materials with third parties without express consent, except as required by law.

12.2 Client Obligations (Proprietary Materials)

The Client acknowledges that all tools, templates, strategy documents, and the "Career Discovery Workbook" provided by the Agent are the proprietary intellectual property of HiringSky. The Client is granted a non-exclusive, non-transferable license to use these materials for their personal job search only. The Client agrees not to share, resell, distribute, or publicly post these materials.

13. Modification of Terms

HiringSky reserves the right to update, modify, or replace any part of this Agreement at any time. Any changes will be effective immediately upon posting the updated version or providing written notice to the Client. Continued participation in the Service or use of provided assets after any such changes constitutes your acceptance of the new terms.
