Candidate Agent Terms of Service

1. PARTIES

This Candidate Agent Service Agreement (“Agreement”) is entered into between Aero Prime Ventures LLC dba HiringSky (“Agent,” “Company,” “we,” or “us”) and the individual purchasing the service (“Client” or “You”). By purchasing the Candidate Agent Service, you agree to be bound by these terms.

2. SCOPE OF SERVICE

The "Candidate Agent Service" is a fixed-scope, 5-day strategic sprint designed to equip the Client with market-ready assets. It is a consulting and document preparation service, not a recruitment, placement, or headhunting service.

2.1 Deliverables Include:

  • One (1) 30-Minute Career Alignment Session: A live or recorded video session covering the Client's target roles, salary range, unique value proposition, and campaign strategy. Complete upon the session occurring or upon the Agent proceeding with workbook information if the Client no-shows per Section 6.

  • Personal Career Branding Assets:

    • Resume: The resume is developed through a structured collaborative draft process in which the Client provides input and approvals via a shared document. Section-by-section Client approval during the drafting process constitutes acceptance of that section's strategic direction. Upon delivery of the final version, the collaboration document is closed and the delivered version becomes the final approved deliverable. Any subsequent revision requests are subject to the one-round revision limit described above. Each deliverable is subject to one (1) round of Client-requested revisions, submitted within 48 hours of delivery via the project board. Revision requests received after 48 hours or after the one round has been used constitute extended scope under Section 2.2.

    • LinkedIn Revamp: Strategic rewrite of the Client's Headline, About section, up to four (4) Experience entries, and Certifications and Projects sections where applicable. Complete when word document copy have been delivered. Does not include ongoing profile management, connection requests, or content posting.

  • Targeted Search Strategy Brief: A PDF document containing recommended target companies, job boards, and search methods aligned to the Client's goals. This is a strategic roadmap based on current market conditions at the time of delivery. It is not a list of active job openings, guaranteed interviews, or live leads, and it does not update after delivery.

  • Recruiter-Access Scripts: Three (3) outreach message templates for contacting recruiters and hiring managers. Complete upon delivery of the three templates. Does not include personalized writing of individual messages to specific contacts, which constitutes extended coaching under Section 2.2.

  • Asynchronous Coaching: Direct access to the Agent via a private Trello board for strategic questions and feedback during the five (5) business day sprint period. Upon expiration of the 5-day sprint term, the Agent's active coaching participation in the project board concludes. The Client retains ongoing access to the board as a personal reference tool and job search tracker. Post-sprint board access is self-directed — the Agent is not obligated to respond to new comments, questions, or requests added after the sprint term ends. Any post-sprint coaching or Agent engagement requires a purchased Add-On under Section 2.2.

  • Bonus Materials: Delivery of the Interview Playbook PDF and 30-Day Momentum Tracker upon sprint completion.

2.2 Service Extensions (The "Add-On" Option)

The 5-Day Sprint is designed for rapid execution. If the Client requires extended coaching, additional revisions beyond the Sprint, or ongoing support, these services may be purchased as a "Weekly Support Add-On" at the Agent's current consulting rate. The Agent is under no obligation to provide free support beyond the 5-day term. Current Add-On rates are available upon request at contact@hiringsky.com and are confirmed in writing prior to any extended service commencing.

3. SERVICE COMMENCEMENT & REFUND POLICY

3.1 Immediate Commencement

Our service is considered to have officially commenced immediately upon purchase, as you are granted instant access to our proprietary "Career Discovery Questionnaire" and intellectual property.

3.2 Refund Policy

Due to the digital nature of our assets and the reservation of the Agent's time, fees are generally non-refundable. We offer specific exceptions based on the stage of work:

  • Pre-Work Cancellation: If you request a cancellation within 24 hours of purchase AND before you have completed the "Career Discovery Questionnaire" or scheduled your Kick-Off Call, we will issue a full refund minus a 5% transaction processing fee.

  • Post-Work Non-Refundable: Once the Career Discovery Questionnaire has been submitted OR the Kick-Off Call has occurred, the service is considered "consumed" and no cash refunds will be issued.

4. OUR GUARANTEE:

HiringSky stands behind the quality and strategic integrity of every deliverable. Our process has produced measurable results for clients across competitive job markets. Because outcomes depend on market conditions, client execution, and factors outside our control, we do not offer outcome-based guarantees. What we do guarantee is the quality of our work: if any deliverable does not meet the scope described in Section 2 upon delivery, we will revise it until it does.

5. CLIENT RESPONSIBILITIES & INTEGRITY OF MATERIALS 5.1 The "Homework" Requirement

You agree to complete the "Career Discovery Questionnaire" in full before scheduling your Kick-Off Call. Failure to provide detailed information may result in the rescheduling of your call.

5.2 Timely Participation

Our 5-Day Sprint relies on momentum. You agree to provide feedback on drafts within 24 hours via the project board. Delays caused by the Client may result in the service timeline ending before revisions are complete. All work and communication occur during business days (Monday-Friday, 9:00 AM - 5:00 PM EST), excluding Federal Holidays.

5.3 Strategic Exclusivity & AI Prohibition

The Agent invests significant expertise in the strategic positioning, keyword architecture, and narrative framing of all delivered materials. To protect the integrity of the campaign and the Client's own outcomes, the Client is strongly advised not to fundamentally alter delivered materials using AI generation tools, third-party resume services, or substantial self-editing during the active sprint period.

  • Material Alteration Defined: A "material alteration" occurs when the Client substantially rewrites, regenerates, or replaces the strategic content, structure, or language of any delivered asset — including through the use of AI tools such as ChatGPT, Claude, or Resume.io — such that the Agent's original strategic work is no longer substantially intact.

  • Agent's Right to Withdraw: If the Agent becomes aware that delivered materials have been materially altered, the Agent reserves the right to: Withdraw from further revision, coaching, or support related to the altered materials Declare the sprint deliverables complete as originally delivered Terminate this Agreement without refund, as the Client has materially changed the scope of the engagement

  • Liability Disclaimer: The Agent bears no responsibility for errors, omissions, keyword failures, ATS rejections, or negative outcomes resulting from materials that have been materially altered by the Client after delivery. The Client assumes full responsibility for any version of their materials that deviates from the Agent's final approved deliverable.

5.4 Collaborative Draft Conduct

During the resume drafting process, the Client's role in the shared document is limited to answering Agent questions, providing factual information about their experience, and approving or requesting clarification on draft sections. The Client agrees not to directly rewrite, restructure, or replace Agent-drafted copy within the shared document. Substantive edits made directly by the Client to Agent-drafted sections within the collaboration document constitute a material alteration under Section 5.3 and the Agent reserves the right to treat the Client's version as the final deliverable without further revision obligation.

6. SCHEDULING & RESCHEDULING

  • Time Zone: All appointments are in America/(EST/EDT).

  • Rescheduling: You may reschedule your session one (1) time for free with 24 hours' notice.

  • Late Cancellation/No-Show: If client cancels rescheduled session with less than 24 hours' notice or arriving 15+ minutes late forfeits the session. The service will proceed based on the information provided in your file. In cases of genuine emergency, the Client may request a one-time exception by contacting contact@hiringsky.com within 24 hours of the missed session. Exceptions are granted at the Agent's sole discretion.

7. DISCLAIMER OF RESULTS (NO PLACEMENT GUARANTEE) HiringSky is a Strategic Advisor, NOT a Placement Agency.

You acknowledge that:

  • We do not have control over hiring managers, ATS algorithms, or market conditions.

  • We do not guarantee interviews, callbacks, or job offers.

  • Any "leads" or "contacts" provided are for networking purposes only and do not constitute a referral or job promise.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Aero Prime Ventures LLC dba HiringSky shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. In no event shall our total liability exceed the actual amount paid by you for the service.

9. CLIENT CONDUCT & TERMINATION AT WILL

We foster a professional, respectful, and collaborative environment.

9.1 Prohibited Behaviors The Agent reserves the right to terminate this Agreement immediately, without refund, if the Client engages in:

  • Harassment: Abusive, aggressive, or demeaning communication toward the HiringSky Agent or staff.

  • Unreasonable Demands: Expectation of communication outside business hours, excessive messaging volume (spamming), or demands for services outside the Scope (Section 2).

  • Strategic Non-Compliance: Consistently ignoring strategic advice or altering materials (see Section 5.3) in a way that sabotages the campaign's success.

9.2 Termination Procedure

In the event of termination for conduct, the Agent will provide written notice via email. Access to the project board may be revoked, and all work completed up to that point will be considered the final deliverable.

10. NON-DISPARAGEMENT

The Client agrees not to make knowingly false or materially misleading statements about HiringSky or Aero Prime Ventures LLC on any public platform. This section does not restrict the Client's right to share honest opinions or factual accounts of their experience.

11. DISPUTE RESOLUTION

A. Informal Resolution: If a dispute arises, you agree to first email us at contact@hiringsky.com to resolve the issue informally in good faith.

B. Binding Arbitration: If unresolved within thirty (30) days, any claim shall be resolved through final and binding arbitration under the rules of the American Arbitration Association (AAA). You waive your right to a trial by jury or to participate in a class action lawsuit.

12. GOVERNING LAW & VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Venue: Any legal action or proceeding arising under this Agreement that is not subject to arbitration shall be brought exclusively in the federal or state courts located in Pinellas County, Florida.

13. CONFIDENTIALITY & INTELLECTUAL PROPERTY 13.1 Agent Obligations

The Agent agrees to keep all Client career data, resume details, and coaching conversations strictly confidential. The Agent will not share the Client's specific application materials with third parties without express consent, except as required by law.

13.2 Client Obligations (Proprietary Materials)

The Client acknowledges that all tools, templates, strategy documents, and the "Career Discovery Questionnaire" provided by the Agent are the proprietary intellectual property of Aero Prime Ventures LLC. The Client is granted a non-exclusive, non-transferable license to use these materials for their personal job search only. The Client agrees not to share, resell, distribute, or publicly post these materials.

14. MODIFICATION OF TERMS

HiringSky reserves the right to update, modify, or replace any part of this Agreement at any time. Any changes will be effective immediately upon posting the updated version or providing written notice to the Client. Continued participation in the Service or use of provided assets after any such changes constitutes your acceptance of the new terms. Modifications to this Agreement will not apply retroactively to agreements already in active service at the time of the change. Clients with active sprints will complete their service under the terms in effect at the time of purchase.
