Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the HiringSky website, online store, and any content or features provided thereon (collectively, the “Site”). By using the Site, you agree to these Terms.
Services Purchases: If you purchase any HiringSky service, your purchase is also governed by the HiringSky Master Services Agreement (MSA). In case of conflict between these Terms and the MSA for services you purchase, the MSA controls.
1) Eligibility & Account
You must be 18+ (or the age of majority in your jurisdiction).
You are responsible for your account credentials and all activity under your account.
2) Permitted Use
You may use the Site for lawful purposes related to evaluating and purchasing HiringSky services. You agree not to:
Copy, distribute, or scrape Site content or underlying code;
Interfere with Site operation or security, or attempt unauthorized access;
Post or transmit unlawful, infringing, or misleading material.
3) Information You Provide
You represent that all information you submit (e.g., contact details, resumes) is accurate and you have the right to provide it. You grant HiringSky a limited license to use that information solely to deliver services and operate the Site.
4) Purchases, Pricing & Subscriptions
Purchases made through the Site are processed by Shopify and/or its payment partners. Prices, taxes, and promotions may change at any time.
If you enroll in a subscription, it auto-renews monthly until canceled per the cancellation instructions shown at checkout and in the MSA/Refunds pages. The MSA governs all service-level payment, refund/credit, and performance remedies.
5) Intellectual Property (Site Content)
The Site, including text, graphics, logos, and templates, is owned by HiringSky or its licensors and protected by IP laws. Except as allowed by law or with our written permission, you may not copy, modify, distribute, or create derivative works from the Site content.
6) User Content (e.g., reviews/comments)
If you post or submit reviews, comments, or testimonials on the Site, you grant HiringSky a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for Site operations and marketing, subject to our Privacy Policy.
7) Third-Party Links & Tools
The Site may link to third parties (e.g., scheduling tools, payment processors, Breezy HR). HiringSky is not responsible for third-party sites, terms, or privacy practices. Your use of those services is at your own risk and may be governed by their terms.
8) No Professional Guarantees
Content on the Site is for informational purposes only and not legal, financial, or employment advice. HiringSky does not guarantee interviews, job offers, or employment outcomes. See the MSA for service-specific limitations and disclaimers.
9) Privacy
Your use of the Site is also governed by our Privacy Policy (how we collect, use, and share data) and our Cookie/Tracking disclosures (if applicable).
10) Disclaimers & Limitation of Liability
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIRINGSKY DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIRINGSKY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/OPPORTUNITY/DATA.
For purchases of services, the liability cap in the MSA applies. For pure Site use without a service purchase, HiringSky’s total liability shall not exceed US $100.
11) Dispute Resolution; Arbitration; Class Waiver
These Terms are governed by the laws of [State/Province, Country].
Any dispute relating to the Site or these Terms will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules (or comparable body in your region), conducted remotely unless otherwise agreed.
Class/collective actions are waived.
For service purchases, the MSA’s arbitration clause applies and controls in case of conflict.
12) Changes to the Site or Terms
We may update the Site or these Terms at any time. Material changes will be posted with a new “Effective Date.” Your continued use of the Site after changes constitutes acceptance.
